This e-mail is in response to your request for information on appointed counsel in Utah.

In civil cases,

counsel is only provided in juvenile court cases. The statute is Utah Code section 78-3a-913.

In criminal matters,

Utah Code Title 77, Chapter 32. Counsel is provided for indigent defendants who face a potential jail or prison sentence. Indigency is defined as someone who does not have income, assets or other means available to employ counsel. A person is presumed indigent if their income is less than 150% of federal poverty levels.

The Governor's office requested me to respond to your e-mail concerning appointment of counsel. Wyoming Statutes provide for appoint of counsel as follows:

Criminal Matters:

Wyo. Stats. 7-6-101 to 7-6-114 provides for appointment of counsel (i.e., the Public Defender's Office) for needy persons under arrest or charged with committing a crime.

Juvenile Matters:

--Juvenile Delinquency: Wyo. Stat. 14-6-222 provides for appointment of an attorney for juveniles charged with committing a delinquent act.

--Child Abuse/Neglect: Wyo. Stat. 14-6-221 provides for appointment of an attorney in child abuse and neglect proceedings.

--Child in Need of Supervision (CHINS): Wyo. Stat. 14-6-422 provides for appointment of an attorneys for children in need of supervision.

Civil Matters:

--Termination of Parental Rights: Wyo. Stat. 14-2-318 & 14-2-319 provides for appointment of attorneys for parents in termination of parental rights actions.

--Involuntary Hospitalization: Wyo. Stat. 25-10-110(h) provides for appointment of an attorney in an involuntary hospitalization.

—Domestic Violence: Wyo. Stat. 35-21-104 provides for appointment of an attorney in one seeking a domestic violence protection order.

--Order of Protection (Stalking order): Wyo. Stat. 7-3-507 provides for an attorney for one seeking an order of protection.

--Guardian ad Litem: Wyo. Stat. 3-2-104 & 20-2-105 provides for appointment of a guardian ad litem (generally an attorney).
